But that's still legal, as far as I know.

That isn't legal, of course, and is the probable source of the error 
- although an argument can be made that the server should be 
rejecting this.

They're equivalent, according to the XML specs.

Not that I'm disagreeing that both this and the spurious namespace 
shouldn't be changed, but they should have no effect other than the 
octet count.
