I don't know about the situation in other countries, but in Britain a 
copyright owner can ask for an "account of profits".  This means that 
the pirate has to pay the amount of money he made by piracy.  He can't 
say that the software he pirated was free, therefore no financial loss 
and so no damages.

Because of this, it's lunacy to base a business on pirated software. 
You are simply doing free marketing for the copyright owners.  If you 
are unsuccessful you might escape a trip to court.  If you are 
successful you certainly won't, because there is a big pot of money for 
the copyright owner and the lawyers to dip into.
