How about this as a Solution:

-  Jabber.com sells the "Jabber" trademark to the
Jabber Foundation.

-  The Jabber Foundation provides requirements for
using "Jabber" in product names, company names, etc. 
The Foundation owns the "Open Source Brand".

-  The Jabber Foundation collects 2% royalties on
commercial products using their "Jabber" trademark in
the product names, company names, etc.

-  Jabber.com doesn't pay royalties until the cost of
their "Jabber" trademark is recouped.

-  Thus, the Jabber Foundation has a source of
funding, Jabber.com gets back the money they paid for
"Jabber", the Jabber Community isn't controlled by a
single corporation, and all corporations have a fair
shot at using the "Jabber" trademark.
