I also suggest this.

Tradenames are an important issue -- even for an Open Source effort.

Make sure you have documents showing use in commerce before him.

A great way to check this (though not guaranteed) is to check the date of is
domain, then check the pages on his products for when they began shipping,
etc. (save all that info.)...only THEN should you contact him and demand he
change his name.

It's better to do this with an attorney BTW.  Chances are it will get done
quickly...otherwise he mag argue with you while he files for registration.
